房東注意!租屋電費新制15日上路 超收最重可罰50萬

不少租屋族在承租簽約時,會被房東告知電費計算方式與台電不同,時常傳出有房東已超過台電公告價格來計價,讓租客用電時都得小心翼翼。為了防止這樣的情況,行政院已核定修正「住宅租賃定型化契約應記載及不得記載事項」,預計將在本月15日正式生效上路,將在新版租賃契約中明訂收費標準,若超收最重可處罰緩50萬元。

為保障國人租屋權益,促進租屋電費計收公平合理及電費資訊透明,內政部次長董建宏昨(4日)在部務會報後記者會表示,行政院3日已核定「住宅租賃定型化契約應記載及不得記載事項」,內政部目前正辦理公告作業,預計於7月15日正式生效上路。

董建宏強調,住宅租賃契約全面適用消保法,租屋電費新制上路後所訂租約,房東如違反規定超收電費者,房客可向縣市政府消保或地政單位提出申訴要求改正,如不改正者,可處3萬至30萬元罰緩;又仍拒不改正者,並可加重處5萬至50萬元罰鍰,且得按次處罰,提醒房東勿以身試法。

關於租屋電費新制內容,地政司報告說明指出以下重點:以「用電度數」計費者,不得超過電費單當期每度平均電價;若「非以用電度數」計費,所收取的電費不得超過電費單每期電費總額

在公共設施電費的部分,若未申辦分攤併入租屋處電費內者,房東不得額外收取;另外,房東有義務提供電費資訊,房客也可自行向台電申辦查詢電費資訊。

地政司長王成機提到,在新制上路之前,仍適用舊制,上路之後所簽的合約必須適用新制,舊契約不溯及既往,但租賃雙方若同意即可適用新制。

為了讓房東和房客了解租屋電費新制規定,地政司已同步製作懶人包及Q&A等資料,放置於內政部地政司網站「租賃條例專區」。新版租屋電費住宅租賃定型化契約書範本,也將於公告後放置於官網供各界查詢使用。

至於是否會有房東因為電費新制而將成本轉嫁租客,或是趁機調漲房租,王成機說,這次修正是讓電費收更公平合理,符合實支實收的原則,沒有轉嫁的問題,應該不會造成租金提高,董建宏也說,若有房東不當提高租金,可向消保會檢舉。
