【換屋退稅攻略3】房地合一400萬免稅額 需自住超過這年限

換屋族注意!拉長持有房屋的年限,稅金會跟著遞減,要是符合自住滿6年,還有400萬免稅額的優惠,剩餘的再以優惠稅率10%計算;算一算,自住和非自住要繳的稅金差很大。

「為避免民眾因為賣房所得的錢,不夠買新房,政府特別規定,民眾重購自用住宅房屋,可以申請退回賣屋所繳的房地合一稅,用來補貼重購新屋的不足款。」財政部官員說明,《所得稅法》規定,重購自住宅可申請稅額扣抵或退還。

不只有重購退稅優惠,要是自住滿6年再出售,房地合一稅就能享自住優惠條件,差距達數倍之多。舉例來說,郭小姐買進2,820萬元的新屋,自住滿6年以3,350萬元售出,獲利的530萬元,因符合自住條件可扣除400萬元免稅額,超過的130萬元,則以優惠稅率10%計算,亦即房地合一稅為13萬元。

要是沒好好善用優惠條件,以一般標準計算,由於持有房屋期間5到10年的課稅級距是20%,因此需繳納房地合一稅106萬元(530萬元×20%),兩者差距達8倍之多,相當驚人。

要注意的是,現行房產交易稅率採雙軌制,是以舊宅取得時間作為基準日,相關規定是,2016年1月1日(含)以前取得的房屋,適用舊制「財產交易所得稅」,基準日後屬於新制「房地合一稅」。

KPMG安侯建業稅務投資部執業會計師黃彥賓指出,只要是新制,無論是「以小換大」或「以大換小」都能退稅,但舊制就得注意「以大換小」沒有退稅優惠了。

永慶房屋契約部資深經理陳俊宏則點出新舊制的不同,「舊制於次年併入個人所得稅,按級距課稅;至於新制要在過戶的30天內主動申報。」另外,舊制的房屋「戶籍登記」須為本人或其配偶、直系親屬,而新制中的「直系親屬」則限縮為「未成年子女」。
