魔鬼藏在契約裡! 律師教戰買屋、賣屋「自保小撇步」

房貸申貸困難,賣房族、購屋族可以如何「自保」?最新一集《地產詹哥老實說》邀請梅子律師温毓梅,分析房屋買賣契約的眉角,告訴讀者在合約中可以備註哪些內容,另外針對過去預售已購客,遇到央行溯及既往的信用管制,該如何主張自身權益。

實務上,由於購屋貸款變數多,買方都會希望在合約中備註若貸款成數不足就解約。温毓梅提醒:「契約備註一定要特別注意兩個字眼,包括『無條件』解約、『無息」返還已支付價金。」

同時站在賣方的角度,也會希望在契約中備註,不論任何原因,只要貸款無法順利下來,買方就得賠違約金。温毓梅表示:「實務上貸款下不來,要看是否與個人因素有關,有些賣方僅會在契約中備註,若與個人因素有關致交易無法順利進行,才得賠違約金。」

温毓梅舉例:「先前新竹有一個案,就是買方受到央行919第七波選擇性信用管制影響,是因為政策因素使得貸款出問題,交易無法順利進行,最終法院也是判買方勝訴。」

事實上,央行選擇性信用管制普遍來說溯及既往,也就是說幾年前購買預售的消費者,如今交屋就可能面臨貸款成數不夠、資金不足的窘境。

温毓梅表示:「建商預售合約相當關鍵,就看合約中有沒有載明約定清楚,合約審閱期有5天時間,一定要多加留意,若內容不合理就不要買了。」

温毓梅表示,據《民法》225條規定,不可歸責於債務人事由,是免給付義務的,「可用這一條與建商談判爭取,像是履約期拉長等等,此外也建議可以集結其他已購戶,組成團體來談判,會更加有力,若還是不行,還可以走法院、仲裁的申訴管道。」
