下訂後人間蒸發!「房市幽靈客」激增 專家:違約將觸法

近期房市「幽靈客層」出現,讓不少代銷業者頭痛,所謂幽靈客,並非沒有購買力,而是「有下訂、卻不履約」的一群,讓建商及代銷追款困難,專家表示,合約成立後,不履約可依法沒收已繳款項,並保留後續求償或重新銷售的權利。

近期房市「幽靈客層」出現這類買方往往在銷售初期快速進場,甚至當場下訂、繳交小額訂金,但隨著時間推進、工程進入開工或結構期,問題開始浮現,包含聯絡不上人、訊息不讀不回、期款遲遲未繳,甚至直接「人間蒸發」。

一名代銷人員透露,過去頂多遇到個別買方延遲付款,但近一年「幽靈化」比例明顯上升,部分個案甚至傳出約1成買方出現異常狀況。到後期變成追款困難,建商只能不斷透過電話、通訊軟體聯繫,最後甚至走向寄發存證信函的程序。

其實這類現象背後,與市場結構轉變密切相關,過去房市多頭時期,不少投資客以低門檻訂金卡位,等待轉售套利,然而當市場反轉、價格預期不再上升,甚至出現修正壓力,這些短線資金開始退場,選擇放棄已付訂金,將損失控制在最小範圍內。

《住展雜誌》發言人陳炳辰表示:「在預售屋交易中,當買方完成下訂並簽署買賣契約書,同時支付訂金或簽約金後,即視為買賣契約正式成立,雙方權利義務隨之生效。若任一方未依約履行,則構成違約,建商得依契約約定催告限期改善,逾期仍未履行者,可依法沒收已繳款項,並保留後續求償或重新銷售之權利。」

值得注意的是,陳炳辰說:「訂金沒收雖然在合約上站得住腳,但對建商而言並非完全利多,包含退戶重新銷售需重新包裝、重新定價,若市場氣氛已轉冷,未必能以原先價格順利去化。另外,多個案場打出低首付到交屋的,也同樣是市場未爆彈。」
